Yesterday I received a letter from the Franchise Tax Board saying that my refund was intercepted and sent to Alameda County Central Collections. WTF! All my fines are paid!
I called the phone number on the letter and two extremely nasty woman got on the phone. The first one was just a miserable lowly operator. The second one was a miserable deputy in the collections department.
They insisted I owed the money and treated me like shit over the phone. We haven't received a payment on this account since 2012, barked the deputy. "But I'm paid up," I insisted. Realizing I was not going to get through to them the call ended.
I sat for a short while and thought about it. How the fuck can I owe them anything? I paid all my fines?
Then bang! It came to me. They hadn't received a payment since 2012? My dad died about five years ago.
I called back again. Sure enough, they were wrong! Central Collections had sent my dad's unpaid fines to the FTB and the FTB intercepted my refund.
Incompetent damned asses! Jeeezuzzz fuck'n Christ! Alameda County Central Collections has incompetents in its ranks. How can they be so stupid?
I used to be a collector so I know that "real" collectors have access to data bases that will instantly provide name, address, SOCIAL SECURITY NUMBERS, and AGE of the people being searched for. These data bases also report if the social security number has been reported as DECEASED.
How is it that these incompetents in Central Collections couldn't figure that out.
My next step is to sue the County and the deputy I spoke to.

I'm perfectly aware of the obstacles I have in suing a government agency and its employees. They do not fall under the Fair Debt Collection Practices Act as private collection firms and employees do. But come hell or high water I'm going after them to the best of my ability.

I found many links that basically said that a government entity nor its employees can be sued, usually. But most articles I read had to do with tort law or something of that sorts. I'm suing them for my money!!!!!!
I have been thinking about this matter and it seems that the best approach is to go the courthouse where the fines originated, show the judge proof that they have been paid in full, and request some sort of relief from the miserable incompetent collector in Central Collections.
